The court has an “independent obligation to protect the integrity of these judicial proceedings”.

A condition of release prohibiting the defendant from making statements that pose a substantial, immediate, and foreseeable threat to law enforcement agencies involved in the investigation and prosecution of this case is warranted and necessary. Such a prohibition would also minimize further prejudice caused by the defendant's sending false and inflammatory messages about the facts of this case to potential jurors who may be called by the court for jury service in this matter.

Prosecutors argued that without medication on the terms of Trump's release, the former president could not have manipulated witnesses and jurors. Judge Eileen Cannon rejected Smith's first attempt at a gag order, so the Special Counsel is trying again.

It seems likely that Cannon's constant defense of Trump from the bench will be appealed at some point. Special Counsel Smith appears to be taking all reasonable steps to protect witnesses and jurors.
